The Deadline for questions concerning the RFP is February 13th to 24th, 2012 (please note all questions and answers will be shared, on an unattributed basis, with every potential bidder requesting this service).

TERMS OF REFERENCE – Village Development Master Plan
Purpose and Objectives

Introduction

These Terms of Reference provide the information required to invite proposals from qualified firms to assist the Township with the preparation of a Village Development Master Plan for the Village of Minden. The document also provides the information to help qualified firms prepare and submit high-quality proposals in an efficient manner. This in turn will support sound decision-making by the Township in awarding and managing the ensuing project.

Background to the Terms of Reference
The Township of Minden Hills is an Ontario municipality with roughly 5,500 permanent residents (2006 Census data) in an 850 square kilometre area roughly two hours northeast of Toronto. From May to September of each year, the Township’s population swells by roughly 20,000 as seasonal residents take advantage of the natural beauty of the area. Minden Hills’ population grew by roughly 4.6 per cent in the 2001-2006 period, in part because some seasonal residents are converting their properties to year-round homes. A recent single detached home subdivision development is also attracting the attention of middle-class income homebuyers within and outside the Township. A new Canadian Tire Store and Gas Bar will open in the spring of 2012 and a new Dairy Queen Grill and Chill Restaurant will open in early summer 2012.
These developments signal the likelihood that population growth will continue in Minden Hills. The Township of Minden Hills strives to be a proactive municipality. It is the only municipality in the County with a water and sewer system (in the Village of Minden). In addition to an EMS base, the Haliburton Highlands Health Services (Minden Hospital) offers emergency services. Hyland Crest Seniors Home offers long term care to seniors, and the Minden Medical Centre houses one doctor and a Family Health Team. All of these services are important to attract and retain residents and businesses alike. The Township’s current operating budget is approximately $5 million a year.
In November of 2011 the Township of Minden Hills discussed its Economic Development Plan for the community. There are a number of strategic components to the plan but one of the underlying fundamentals is the need to get more people living in the village of Minden.
Council, Management Staff and the Economic Development Committee agreed that retirees could be a way to grow our population. Retirees bring additional demand for goods and services without the expectation of finding, or need for, employment.
If we are to make the village of Minden a retirement destination we need to ensure that the infrastructure and support services are in place. This includes health care, housing, transportation, recreation, entertainment, etc. Several initiatives are underway to address these infrastructure and service needs.
We need however to ensure that there is ease of movement for those less mobile retirees throughout the village. The village also needs to look like an attractive destination.
In 2011, the Municipality passed a Property Standards bylaw. This will provide a useful tool for improving the appearance of the Village of Minden.
The Village of Minden, and its businesses, used to be an active destination for snowmobilers during the winter months but this activity has fallen off considerably in recent years due to the deterioration of the trail systems leading to the Village. A project was undertaken in 2011 to revitalize snowmobiling in the township. This involved renewing the trails that connect the Village to the main snowmobile trails as well as developing trails through the Village so riders don’t have to travel on roads. It is anticipated that these improvements will once again make Minden an attractive snowmobile destination to the benefit of its residents and businesses.

Objectives of the Village Development Master Plan Process and Outcomes

The Village Development Master Plan process and the outcomes from it are expected to:

Develop a plan for the village of Minden, the purpose of which is to outline ideas to improve traffic flow, provide adequate parking, improve and encourage pedestrian movement, provide accessibility throughout the village in general and in particular to the downtown businesses, to address drainage issues in certain areas of the village, to recommend the best locations for seniors housing and/or affordable housing and to generally improve the appearance of the village.

Plan Area/Geographic boundaries (include maps)
• The Village of Minden: The area to be considered in the plan is the Village of Minden lying to the West of Highway 35 in the Township of Minden Hills.

Scope of the Assignment
• Rather than take a piecemeal approach to village planning, we wish to look at all of the issues that need to be addressed in order to improve the overall functionality and appearance of the downtown core.

Mandatory Standards of Work
• The consultants will be expected to work from but not be limited to existing plans and information to be provided for their assistance.
• Where specific components of work so require, the successful bidder will ensure that these components are undertaken or reviewed/signed off by one or more members of the consulting team with appropriate professional credentials and qualifications. Bidders are encouraged to identify these components in their proposals along with the standards which will be applied in each case.
• We expect that the successful proponent will bring extensive experience to the project, developed from working on similar assignments in the past.

Deliverables Expected from the Village Development Master Plan

Following is a list of issues that we feel need to be addressed. This list is not necessarily all-encompassing and we would look to the provider to raise and address other issues as they feel necessary.

• A new Canadian Tire store and gas bar are currently being built at the corner of Highway 35 and Water Street. We anticipate and desire that this new store will bring a lot more traffic to the downtown core. How can we best accommodate and encourage this additional traffic to the benefit of the downtown businesses?
• We have 2 difficult/dangerous intersections that need to be addressed (Bobcaygeon Road/Newcastle Street and Bobcaygeon Road/Water Street). There is a need to improve traffic safety as well as safety for pedestrians crossing the main street. There is also an issue with large vehicles turning right from Water Street onto the bridge having to encroach into the other lane of traffic on the bridge.
• We have a need for space for a commercial/industrial park, located in such an area so that trucks don’t have to travel through the downtown business area. How can this be best accommodated?
• we have a need for wider sidewalks to accommodate pedestrian traffic and seniors needs (e.g. Scooters). How can we best accomplish this while still maintain parking on the main street?
• The sidewalks on the bridge across the Gull River are too narrow to allow pedestrians to pass people on scooters or with baby strollers without stepping off the sidewalk into the traffic area. Would a solution to this be to eliminate the sidewalk on one side of the bridge in order to widen the sidewalk on the other side, or is there a better solution?
• Stores will need to meet accessibility requirements over the next few years. How can we best do this, recognizing the different elevations of the existing store fronts?
• we need additional parking downtown. Where are the best places to locate this?
• There is a need for a park/playground area in the downtown core within easy walking distance for residents to take their children/grandchildren. Where could this best be located?
• What would be the benefits/economic development potential created by a 2nd bridge over the Gull River? If there would be a benefit, where would it best be located and what street changes would be needed to accommodate this?
• We have drainage issues in certain areas of the village which need to be addressed with a view to making more land available for development.
• We need to determine the best areas of the village to locate Affordable Housing / Seniors Housing
• Should the Municipality look at acquiring land if it becomes available? If so, in what areas?

The consultants should develop a multi-year implementation plan (assuming a five to 10 year timeframe) with major initiatives/projects, key decision points and milestones identified. This implementation plan would provide Council with guidance on which initiatives to act on, in what order, and over what timeframe.

Because Township Council will want to pursue external funding to support implementation of various initiatives identified in the Plan, the successful consultants will be encouraged to write the Plan so that sections could be extracted to support funding applications for each initiative. For instance, this might be done through a one page summary of each major initiative, covering the description, timeline, costs and benefits/rationale. Bidders are encouraged to reflect this approach in their submissions in response to this RFP.

Specific Studies and Plans linked to the Overall Strategy/Plan including:
• Traffic Flows Analysis for the core area of the Village of Minden.
• Recommendations on economic development merits of a second bridge crossing the Gull River on the west side of the Village of Minden (near the sewage plant – Orde Street).
• A Streetscape Improvement Strategy and Streetscape options for the whole village of Minden.
• Suggestions on potential funding sources to assist with underwriting the costs of any initiatives recommended by the consultants would be helpful; it is not anticipated that any funding applications would be prepared as part of the Economic Development Master Plan project.

Process Requirements Associated with the Project

The successful proposal must address the following process requirements:
• Review of existing background reports/documents (See list in Appendix A)
• Presentation of draft Plan to Council
• Two (2) public meetings to be held during the project period, one of which will be held to allow public input on the plan generally (i.e. before the draft plan is presented to Council) and a presentation of approved and adopted Plan. At their own discretion, consultants may choose to recommend use of meeting formats other than a traditional public meeting (for example, charettes, breakout groups etc.) For any public meeting related to the project, the successful bidders will be expected to lead the organization and execution of these meetings.
• Bi-monthly progress reports to the Township’s designate to allow updating of Council on the status of various project activities.
• Final report for ongoing use by Township Council and staff as well as by the public.

Notations Related to Project Budget
• The Township of Minden Hills is not obligated to accept the lowest price bid and is not obligated to award any contract as a result of this Request for Proposal call.
• All prices shall include any applicable taxes except HST.
• Bids will be viewed by the Township as fixed price; it is the responsibility of the bidder to inspect all material or make sufficient enquiries to satisfy him/herself that the work described in the bid can be performed within the proposed project budget. Any project costs which bidders expect to be financed from other Township resources must be specified in the bid proposal. Otherwise, the Township will assume that any and all costs will be covered from the bidder’s proposed budget.
• Additional work (beyond that specified in an agreement between the Township and the consultants) will only be performed upon written authorization of the Township of Minden Hills or it’s designate.

Reporting/Signoff Relationships
• The primary contact will be Mr. Gerry Morrison, CAO (705-286-1260 extension 213), who will handle all liaison with Council and will provide assistance to the consultants on identification of key stakeholders to be included in any consultation as well as support in promoting awareness of and attendance at any public consultation meetings.

Project Timelines, Milestones and Schedule Parameters
• January 30, 2012: Request for Proposals based on approved Terms of Reference issued
• February 13 – February 24, 2012: Timeframe for electronic submissions of questions; all questions and answers will be shared (on an unattributed basis) with any potential bidder requesting this service.
• February 13, 2012 @ 1:00 p.m. Township of Minden Hills, second floor boardroom, 7 Milne Street, Minden: Bidders’ meeting/opportunity to ask questions, view materials (hard copies will be available in the boardroom that day for review) and participate in an organized tour of the community. • March 12 2012: Bids opened at 10:00 am at the Township offices

• March 30, 2012: Successful bidder notified
• April 5, 2012: Agreement negotiated; project work commences

Process for any Modifications to the Project
• Modifications to the proposed plan of work may be negotiated with the successful bidder, culminating in a written agreement between the Township of Minden Hills and the selected consultants.
• Additional work (beyond that specified in an agreement between the Township and the consultants) will only be performed upon written authorization of the Township of Minden Hills or it’s designate.

Summary of Proposal Requirements
In a maximum of 25 pages (not including appendices), bidders are invited to address the following proposal requirements:
• Description of the approach to the assignment (how the consultants will ensure completion of project deliverables --- see preceding section).
• Proposed project timeline identifying bi-monthly reports to the Township’s designate, public consultation(s), milestones and key decision points
• Budget and proposed payment schedule to consultants
• Statement of insurance coverage (professional liability and commercial liability)
• Principals to be assigned to the project with bios (one page maximum for each principal with relevant experience and professional qualifications/designations highlighted)
• Consulting commitment (number of days of work anticipated for any/all human resources to be assigned to the project; identification of project manager and any individuals to be designated as leads for particular aspects of the project)
• References for similar projects (3 minimum). A maximum of six project profiles may be included as an appendix to the proposal.

Bidders are strongly encouraged to present the proposal content so that the Township can identify the relative resources dedicated to the overall strategy/plan and each of the specific studies/ recommendations described in the deliverables section of this Request for Proposal.

Format of Submission
In addition to meeting the 25 page maximum (not including appendices), submissions must use body text no smaller than 12 pt Times Roman or Arial 10.

All submissions (complete sealed tenders) must be received at the Township of Minden Hills no later than 4:00pm on March 9, 2012. Submissions should be addressed to:

Bidders must provide three (3) hard copies and an electronic version of the proposal (on CD). Email and fax submissions will not be accepted. Hard copies must be signed by an officer of the company with the authority to bind the corporation.

Because bidding on this Request for Proposals would constitute a conflict of interest, members of Council are not permitted to participate in this RFP.

Submissions will be opened on Monday, March 12, 2012 at 10:00 am in the Board room of the Township Office.

• The submissions will be reviewed by a six-person committee comprised of the CAO, the Reeve of Minden Hills, the Economic Development Committee Chair, the Roads Advisory Committee Chair, the Roads Superintendent and an external third party consultant to be determined, based on the following criteria.

PROPOSED SCOPE OF SERVICE
The work to be performed by the Contractor under this contract consists of water quality sampling and analysis, annual topographic capacity surveys, and annual reports for the Townships seven (7) waste disposal sites for a 2 year period, with two 1 year renewal options, at the discretion of the Township.
The Contractor will ensure that all sampling is to be completed as per the sampling requirements detailed in Appendix B (Table 1 to Table 7).

Environmental Monitoring
This work is essential in maintaining compliance with the Provisional Certificate of Approval (PC of A) for each waste disposal site and the MOE. As such, the environmental monitoring shall be completed in accordance with the recently published Ministry of the Environment (MOE) document titled Monitoring and Reporting for Waste Disposal Sites, Groundwater and Surface Water, Technical Guidance Document (November 2010). A competent environmental practitioner (e.g. Professional Geoscientist or Professional Engineer) possessing appropriate training and experience shall execute or directly supervise the execution of groundwater and surface water monitoring.
All collected samples shall be transported to an Environmental Analytical Laboratory accredited by the Canadian Association for Laboratory Accreditation Inc. (CALA) or the Standards Council of Canada (SCC).
Annual Topographic Survey
An annual topographical survey of the Scotch Line and Irondale waste disposal sites is completed to update the surface contours and to generate airspace volume estimates for the annual reports and for the site capacity calculations. All horizontal and vertical survey information are recorded using survey grade global positioning system (GPS) and referenced to a localized coordinate system and benchmark established for the respective Sites. The annual survey is typically scheduled for late autumn of the same reporting period.

Reporting
The contracted firm will complete an annual report for the selected sites to be submitted to the Ministry of Environment. The annual reports will include, as a minimum, the requirements outlined in the Annual Report section of the respective Certificates of Approval. Each Annual Report will contain annual environmental monitoring information as well as operational information related to waste disposal and diversion activities. In accordance with Ministry of Environment guidelines.
The Township will provide any supporting documentation required to complete the report, including Certificates of Approval, Design and Operations Reports, Closure Reports and relevant correspondence with the MOE. In addition to the requirements listed in the Certificates of Approval, each report must include an executive summary and a stamped page indicating review and approval of the report by a qualified CEP (a Professional Geoscientist or Professional Engineer).
The submission timeline requires each report be provided to the Township in draft format for review a minimum of 30 days prior the MOE PC of A submission date. The contracted firm will provide four (4) bound copies and one (1) electronic copy of each report (PDF format).

SUBMISSION REQUIREMENTS
The form of submission shall be no greater than twenty (20) pages. The resume’s of the consulting team, the pricing form and associated appendices are in addition to the twenty page limit.
The form of submission shall include the following:
1. The name, qualifications and experience of all staff assigned to the consulting team, including the location of their base office, their rate of pay and an overview of their role on the team.
2. Submit three (3) references and their contact information for similar type projects. Provide at least three references in addition to any reference for prior work or supply completed for the Township of Minden Hills. Reference information will include the year of the project, the name of the similar project and value, reference company name and a contact person with their phone number and email.
3. Submit a complete list of sub-contractors to be used on this project. The Township shall approve any changes to the list prior to work taking place. Name the sub-contractor, their address and the trade they will perform for the project.
4. Demonstration of the Proponent's understanding and proposed approach to the project.
5. Ensure that all employees and sub-contractors have to be fully trained in regards to Accessibility Requirements as mandated by the Province of Ontario. Employees and sub-contractors will also sign Contractor Accessibility Acknowledgement Forms provided by the Township of Minden Hills.
6. The Price Schedule included in Appendix A is to be completed based on the scope of work, requirements, and specifications. Where significant changes are required in environmental monitoring requirements, the Provisional Unit Pricing fees included in Appendix A will be referenced to estimate the corresponding increase or decrease in associated fees. Unit pricing is required.

Request for Proposals shall be sealed in an envelope which must clearly indicate the name and address of the Contractor to be received at the address indicated below until Thursday, February 16, 2012 at 12:00 pm.

Due to the ever increasing costs of maintaining landfill sites and in order to ensure the Township is in compliance with its Certificate of Approval, the Township of Minden Hills will be placing stricter governance on all construction material and bulky waste entering its
landfill site(s).

Pursuant to Policy # 43 – Operating Policies and Procedures –
Landfill Sites
“Only garbage or refuse originating in the Township of Minden Hills is acceptable at this site. Any individual or company that has been proven to have brought in refuse from outside the boundaries of the Township of Minden Hills could be banned from using the site in future.”

Effective August 25th, 2011, Minden Hills landfill attendants cannot accept only green Minden Hills landfill cards as proof of origin for construction material and bulk waste. A copy of the demolition permit, building permit or a signed letter from the property owner* will be required.

recycling oil, anti-freeze and hydraulic lubricant containers.
The service is of no charge to residents of Minden Hills. There
are considerations the Township requests when residents
bring the containers to the landfills.
They are as follows:
• Please ensure that all pails and containers are empty of
liquid. Only a small residue should remain.
• Please remove all pail lids and place lids in the bags with the
oil jugs.
• Please do not put pails in the bags.
• Please ensure that all pail lids are metal free.
• Please stack pails. Keep the lid on the top pail to prevent
liquid from gathering in the pail.
• Please replace the cap on all oil jugs after draining. This
prevents the pooling of oil in the bottom of the bag.
Collection is available at all Township Landfill and Transfer
Station Locations. If there are any questions about the

NOTICE OF FIRE RESTRICTIONS
From April 1st to October 31st in any year is "Fire Season". During Fire Season, no person shall start a fire outdoors for the purpose of burning piled wood, brush, leaves or discarded wood products unless:

a.) the fire is started two (2) hours before sunset, or later, and is extinguished two (2) hours after sunrise, and

b.) a responsible person is available to tend the fire until it is extinguished, and

c.) the material burned is in a single pile that is less than two (2) metres in diameter and less than two (2) metres high, and

d.) the fire is at least two (2) metres from any flammable materials, and

e.) the person tending the fire has adequate tools and or water available to contain the fire.

Any persons setting an outdoor fire shall be responsible for any damage to property or injury to persons, and be liable for all costs incurred by the Fire Department.

A total ban against outdoor burning may be declared when atmospheric conditions or local circumstances warrant it. Such a ban will be posted at the Tourist Information Centre, located on Highway 35 in Minden, and at area businesses. It is YOUR responsibility to be aware of fire bans.

Please be advised that the Scotch Line Landfill Site accepts E-Waste at no charge. Please deposit your E-Waste in the bin provided specifically for E-Waste. Thank you for your cooperation.
